MINNEAPOLIS -- The NFL Players Association plans to appeal a judge's ruling in the case of five players facing suspensions over positive drug tests.
The union filed its notice of appeal Wednesday with the 8th U.S. Circuit Court of Appeals.
The players association wants the appeals court to reconsider a judge's dismissal last week of a lawsuit filed by the union on behalf of Vikings defensive tackles Kevin Williams and Pat Williams, and three New Orleans Saints, Charles Grant and Will Smith, plus Deuce McAllister, who was released after last season.
I wish I could see some hope of this working, but I think the dictators have already won.

…but aren’t appeals always made on procedural grounds? I mean, you say essentially “The previous court made a mistake in considering the testimony of Kim Jong Il” or something like that. Rather than, “Can we get a mulligan?”

I just don’t see how this could possibly work. Maybe the NFLPA is just trying to keep the support of the players by going all out over this. I expect most players in the league would agree that this sucks. If relations between the league and the players keep going in the direction they seem to be going, another strike may be coming in the next five years or so. It seems like the the owners and their bulldog Roger Goodell have been striving for a “my way or the highway” approach ever since Goodell became commish. Wouldn’t it be our luck to have a strike in 2013 just when we host the Super Bowl?

Doesn’t she get prosecuted? This is private health history information that is prevented by HIPAA laws to avoid private info to become public. Every commercial entity goes to great lengths to have a Privacy Policy and companies spend millions to incessantly send you those documents annually that everyone tosses away and here there is a fragrant violation and no one is being prosecuted. If this info had remained private, it would have been a whole different situation with an easier solution or compromise.

Once the players and their lawyers exhaust all avenues for overturning the suspensions, I expect they’ll turn their attention to her and Balanced Health Products. She’s probably protected somehow, which is a shame. I don’t see how Balanced Health Products can avoid being sued, though. The players should at least get their lost salaries and probably more out of them. That is, unless there was a warning on the Starcaps label saying, “May contain unlisted ingredients. Use at your own risk” or something legally similar.
